In March 2024, the Rashtriya Swayamsevak Sangh (RSS) filed formal complaints with the Election Commission of India (ECI) and Nagpur Police against Janardhan Moon, stating that he had misused the name of the organization and propagated false information.

Allegations Against Janardhan Moon

Moon called a press conference in Nagpur, where he allegedly said the RSS was voting for the Indian National Congress for the Lok Sabha elections. The RSS said the claim was utterly false and misleading.

Things went even worse, because Moon had also tried to get an organization registered under the name 'RSS' in the past. He had made a request before the Assistant Registrar of Societies that was turned down, followed by dismissal by Bombay High Court and the Supreme Court. Undeterred, Moon continued using the RSS name that the outfit believes is an exercise in deceit of the people at large to vitiate the name.

RSS's Formal Complaints

The RSS's Nagpur Mahanagar secretary wrote letters to the ECI and the Nagpur Police Commissioner based on Moon's actions. The letter accused Moon of personation, cheating by personation, and spreading rumors intended to create enmity. Furthermore, the RSS called for YouTube to remove videos featuring Moon's press conferences to further prevent the dissemination of false information.

Organization asks the authorities to file cases against Moon under specific sections of the Indian Penal Code, such as: 

      •         Section 416: Punishment for cheating by personation.
      •         Section 419: Punishment for cheating by personation.
      •         Section 505: Statements conducing to public mischief.

Besides, RSS demands applying the appropriate sections of the Representation of the People Act, too, stressing there is a need to ensure that Moon would not be able to use the name of RSS in the future. (Deccan Herald)

Present Scenario

As of the latest reports, the Nagpur Police have acknowledged the receipt of the complaint and are conducting an inquiry into the matter. No formal charges have been filed against Moon pending the outcome of the investigation.

Implications

Such an incident depicts the RSS's concern for protecting its name and reputation, especially during sensitive periods like election seasons. The prompt response by the organization indicates that it is keen on preventing unauthorized use of its identity in ways which may mislead people or influence the electoral process.
